Terms of service
Last updated 2026-08-16
These Terms of Service describe the conditions that apply when you request, reserve, rent, or receive party rentals or entertainment services from Giovanna's Entertainment ("Company," "we," "us," or "our"). Your booking confirmation, these Terms, and any Rental Agreement and Liability Waiver you sign form the agreement between the Company and the adult customer who makes the booking ("Customer" or "you").
1. Bookings and definitions
You must be at least 18 years old and authorized to book for the event, venue, and participants. A booking is reserved only after checkout is completed and you receive confirmation from us. Availability remains subject to accurate event information and a safe, serviceable location.
“Equipment” includes all rented items and related components, including inflatables, concession machines, tents, tables, chairs, photo booths, cords, blowers, stakes, and accessories. “Services” includes entertainment and event services supplied by our owners, employees, or contractors. Your order confirmation identifies the specific Equipment and Services included in your booking.
2. Prices, deposit, and payment authorization
Prices, taxes, delivery charges, and the amount due are shown before payment. Unless you choose to pay in full, checkout collects a reservation deposit equal to 20% of the order total. The deposit is refundable when the cancellation requirements below are met.
If a balance remains, you authorize us and Stripe to charge that balance automatically to the payment method used at checkout 2 days before the event. If the event is closer than that when you book, the amount shown by checkout controls. You are responsible for keeping a valid payment method available and for amounts due under the booking, including approved additions and applicable damage, cleaning, loss, return-trip, permit, endorsement, cord, or generator charges described below.
Stripe processes card payments. We do not receive or store your full payment-card number. A payment receipt or successful charge does not waive any responsibility for damage, loss, additional services, or other amounts properly due under these Terms.
3. Cancellation, refunds, and weather rescheduling
You may cancel for a full refund of amounts already paid if the cancellation is submitted strictly before 8:00 AM in the event location's time zone on the event date. The private management link in your confirmation email shows current eligibility and can process an eligible cancellation. At or after that cutoff, the booking may still be cancelled, but no refund is automatic; contact us if you want us to review the circumstances. Bank processing times determine when an approved refund appears on your account.
If weather creates unsafe conditions, you may request to reschedule to an available date within 12 months of the original event. We may refuse setup, delay service, or require early takedown because of high winds, lightning, heavy rain, or another unsafe condition. Once the free-cancellation cutoff has passed, a weather-related shutdown is not refundable, but the weather rescheduling option remains available subject to availability.
Changes to a date, time, address, Equipment, or Services are not effective until we confirm them and may change availability or price.
4. Delivery, setup, and pickup
Our standard rental schedule is delivery by 12:00 PM on the event date and pickup between 7:00 AM and 12:00 PM on the morning after the final rental day. You may request same-day pickup during checkout. Routing, venue rules, safety conditions, and the type of Equipment may require a different window; the schedule we confirm for your booking controls. Some inflatables, concession machines, and photo booths may require same-day pickup unless we approve otherwise in writing.
You must provide clear, timely, and unobstructed access for delivery, setup, and pickup. If access is delayed or unavailable and we must return, a $25 return-trip fee may apply. You may not move Equipment after we set it up unless we give written permission.
5. Customer responsibility, cleaning, damage, and loss
You are responsible for rented Equipment from delivery or setup until pickup. You must protect it from misuse, weather, theft, and unauthorized movement and must promptly report damage, loss, or unsafe conditions.
We may charge a reasonable cleaning fee for excessive dirt or prohibited materials, including food, gum, candy, confetti, glitter, sand, mud, grass stains, pet waste, spills, or sticky substances. A minimum $100 damage charge may apply to tears, rips, cuts, burns, rain or wind damage, dragging on rough surfaces, improper use, unauthorized movement, or failure to follow safety rules. You are responsible for the full reasonable repair or replacement cost when it exceeds $100 and for replacement of missing or stolen Equipment or components.
Silly string, glitter, confetti, paint, fireworks, sharp objects, shoes inside inflatables, and pets inside inflatables are prohibited.
6. Site suitability and power
You must provide a safe, level setup area free of rocks, branches, debris, sprinklers or irrigation, pet waste, overhead wires, low branches, dangerous slopes, and other hazards. We may refuse or stop setup when the site is unsafe or unsuitable.
When powered Equipment is booked, you must provide a dedicated working outlet within 50 to 100 feet of the setup area and avoid sharing that circuit with high-draw appliances. Extra cords or generators may require an additional charge disclosed to you.
7. Supervision and safety rules
You must provide active, competent adult supervision whenever participants use inflatables or other Equipment that requires supervision. You are responsible for ensuring that supervising adults and participants understand and follow all posted or provided rules, capacity and age limits, and Company instructions.
No flips, wrestling, rough play, food, drinks, gum, or shoes are permitted inside inflatables. Equipment may not be used in rain, unsafe wind, or another condition we identify as unsafe. You must stop use immediately if Equipment becomes damaged, loses power or inflation, shifts, or appears unsafe.
8. Insurance, venue requirements, and permits
We maintain general liability insurance. If a venue requires a Certificate of Insurance, you must request it 7 to 14 days before the event, provide the correct legal venue name and address, and pay any insurer endorsement fee disclosed to you.
You are responsible for obtaining and paying for required property-owner or venue permission, HOA approval, permits, and municipal authorization. A venue's refusal or your failure to obtain approval does not automatically create a refund after the cancellation cutoff.
9. Photos and media
Unless you opt out in writing, you give us permission to use non-identifying photos of Equipment setups for our portfolio and marketing. This permission does not authorize us to identify you or a child by name. Tell us in writing before the event if you do not want setup photos used.
10. Assumption of risk and release
You understand that party Equipment and activities involve inherent risks, including slips, trips, falls, collisions, weather-related hazards, electrical hazards, and participant misuse. You voluntarily assume those risks for yourself and, to the extent legally permitted, for the participants under your supervision.
To the fullest extent permitted by Massachusetts law, you release and discharge Giovanna's Entertainment, its owners, employees, and contractors from claims for personal injury, property damage, medical expense, lost wages, and other damages arising from the use or misuse of Equipment. This release does not apply to the Company's gross negligence or willful misconduct and does not waive rights that cannot legally be waived.
11. Minor participants
If minors will participate, the signing parent or guardian consents to their participation, acknowledges the duty to supervise them and enforce the safety rules, and assumes the inherent risks on their behalf to the fullest extent permitted by law. The Customer is responsible for ensuring that all supervising adults understand and enforce the rules.
12. Indemnification and warranty disclaimer
To the fullest extent permitted by law, you agree to indemnify and hold harmless Giovanna's Entertainment, its owners, employees, and contractors from third-party claims, property damage, reasonable attorney's fees, litigation costs, and losses caused by your breach of these Terms, failure to supervise, misuse of Equipment, or failure to follow safety rules.
Equipment is provided “as is” and “as available.” We make no warranty beyond any warranty that cannot be excluded under applicable law.
13. Electronic agreement and records
During online checkout, you must open the Rental Agreement and Liability Waiver, type your full legal name, affirmatively accept its terms, and consent to sign electronically. We record the signature, date and time, IP address, and version of the waiver and attach a signature certificate. You will receive a copy with your confirmation email.
You agree that your electronic signature and electronic records may have the same legal force as handwritten records under applicable law. Contact us before booking if you cannot access, save, or review the electronic document or need another reasonable way to receive it.
14. Governing law and complete agreement
Massachusetts law governs the agreement, without regard to conflict-of-law rules. If legal action is reasonably required to enforce the agreement, the Customer agrees to pay the Company's reasonable attorney's fees, court costs, and collection expenses to the extent permitted by Massachusetts law.
Your booking confirmation, these Terms, and the Rental Agreement and Liability Waiver signed for the booking constitute the agreement between the parties and supersede prior discussions about that booking. The booking confirmation controls the selected items, services, dates, times, addresses, and prices. The payment and cancellation terms displayed by checkout and stated here control payment timing and refund eligibility. The separately signed waiver controls safety, assumption-of-risk, release, and indemnification matters. If any provision is unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law.
15. Contact us
Contact us promptly with questions, booking changes, access issues, safety concerns, cancellation requests, or a request for a copy of your signed records.
Payments are processed by Stripe — Giovanna's Entertainment never receives or stores your card details.
